The Mountain Valley Spring Water “ACM Awards 2025”
Sweepstakes Official Rules

1. NO PURCHASE NECESSARY TO ENTER OR WIN. The Mountain Valley “ACM Awards 2025” Sweepstakes (“Sweepstakes”) starts April 17, 2025 at 8:00 AM EST and ends April 28, 2025 at 11:59:59 PM EST (“Sweepstakes Period”). Sweepstakes is sponsored and administered by DS Services of America, Inc. dba Primo Waters North America (“Sponsor”).
   
   
2. NON-AFFILIATION. THIS SWEEPSTAKES IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH, FACEBOOK, TWITTER, INSTAGRAM OR ANY OTHER SOCIAL MEDIA PLATFORM. YOU ARE PROVIDING YOUR INFORMATION TO THE SWEEPSTAKES SPONSOR AND NOT TO FACEBOOK, TWITTER, INSTAGRAM OR ANY OTHER PLATFORM.  QUESTIONS REGARDING THE SWEEPSTAKES SHOULD BE DIRECTED TO SPONSOR AND NOT TO FACEBOOK, TWITTER, INSTAGRAM OR ANY OTHER PLATFORM.
   
   
3. ELIGIBILITY. Open only to legal residents of the fifty (50) U.S. states and the District of Columbia who are eighteen (18) years or older and of the legal age of majority in their jurisdiction of residence at the time of entry. Void elsewhere and where prohibited. Employees of Sponsor, Dick Clark Productions, LLC, Penske Media Corporation, the Academy of Country Music, and Amazon Prime Video and their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible.
   
   
4. HOW TO ENTER. 

   You may enter the Sweepstakes during the Sweepstakes Period by taking the following actions on Instagram:

   2. Tag a friend in the comments who'd be your award show date
      
      

   Completing both of the above actions during the Sweepstakes Period will result in one (1) entry into the Sweepstakes.

   To enter you can create a new, free Instagram account or use your existing account, and your account settings must be set to “public.” Limit one (1) entry per person during Sweepstakes Period. The same person may not submit multiple entries using different social media platform accounts. Only fully completed entries are eligible. No automated entry devices and/or programs permitted. Entries will not be acknowledged or returned. Proof of submission will not be deemed to be proof of receipt. Entrants fully and unconditionally agree to be bound by these Official Rules (as well as any details indicated in the social post or other directions provided about the Sweepstakes) and the decisions of the Sponsor, which will be final and binding in all matters relating to the Sweepstakes.

5. WINNER SELECTION AND PRIZE. Following the conclusion of the Sweepstakes Period on April 29, 2025, one (1) potential winner will be selected at random by Sponsor from among all eligible entries to receive two (2) tickets to the 60th Academy of Country Music Awards (“ACM Awards 2025”) at the Ford Center at The Star in Frisco, Texas on Thursday, May 8, 2025. Total Prize ARV: $2,400
   
   Limit one (1) prize per person/household.  Prizes are non-transferable and no substitution or cash equivalent is allowed except that Sponsor reserves the right to substitute a prize with one of equal or greater approximate retail value. Odds of winning a prize depend on the number of eligible entries received. Any expenses that may be associated with receipt or use of prize that are not specifically listed herein are the responsibility of winner. All federal, state/provincial/territorial, and local taxes on a prize, as well as any incidental costs that may be associated with the prize, are the sole responsibility of the winner of that prize.
   
   
6. WINNER NOTIFICATION. Eligible winners will be notified by direct message on the social media platform of entry. If applicable, winners must provide an accurate postal mailing address so that prize can be mailed to the recipient. Prior to being confirmed as a winner, an eligible winner may be required to sign and return an Affidavit or Declaration of Eligibility and Liability/Publicity Release within two (2) days of prize notification. If any eligible winner cannot be contacted within two (2) calendar days of first notification attempt, if any prize or prize notification is returned as undeliverable, if any eligible winner fails to return his/her/their winner documents within the time set forth above or otherwise rejects his/her/their prize, or in the event of noncompliance with these Sweepstakes Official Rules, such eligible winner will forfeit such prize and an alternate eligible winner may be selected from all remaining eligible entries, time permitting. Upon prize forfeiture, no compensation will be given. Potential winners must continue to comply with these Official Rules and winning is contingent upon fulfilling all requirements.
   
   
7. PUBLICITY. Participation in Sweepstakes and acceptance of prize constitutes each winner’s grant to Sponsor and its partners and designees of the irrevocable and perpetual nonexclusive right to use, publicly display, print, publish, reproduce, distribute, modify, create derivative works from, and provide access to winner’s entry submission, name, address (city and state/province/territory), likeness, photograph, picture, portrait, voice, opinions, biographical information and/or any statements made by each winner regarding the Sweepstakes or the prize(s) for advertising and promotional purposes without limitation, in any media, worldwide, without notice or additional compensation or consent, except where prohibited by law.
   
   
8. RELEASE AND INDEMNIFICATION: By entering the Sweepstakes, each entrant, on behalf of himself/herself/themself, and his/her/their executors and heirs, agrees: (1) to be bound and abide by these Official Rules and by all decisions of Sponsor, whose decisions are final and not open to appeal; (2) except where prohibited by law, to release, indemnify, defend and hold harmless Sponsor, Dick Clark Productions, LLC, Penske Media Corporation, the Academy of Country Music, Amazon Prime Video, Meta Platforms, Inc., Instagram, LLC, and their respective parents, subsidiaries, affiliates, members, shareholders, agents, representatives, employees, suppliers, agencies, successors, assigns, licensors, advertising or promotional agencies and any prize-sponsoring agency (collectively, "Released Parties"), from any and all liability whatsoever in connection with or related to this Sweepstakes, including, without limitation, from any and all causes of action, liabilities, suits, claims (including, but not limited to, third party claims that may be made against entrants, and claims arising out of or relating to acceptance, receipt, possession or use/misuse of any prize (including any travel or activity related thereto), or any publicity or other public exposure of entrants, including, without limitation, claims concerning infringement or invasion of entrants' privacy or publicity rights, or defamation, or acts undertaken in preparation for, or participation in, the Sweepstakes, cross-claims or counterclaims, costs, injuries, losses or damages or demands of any kind (including, without limitation, personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light) (collectively, "Claims"), WHETHER OR NOT ARISING FROM THE NEGLIGENCE OF A RELEASED PARTY; (3) on behalf of himself/herself/themself, and his/her/their executors and heirs that he/she/they has no right to bring, and covenants not to bring, any claim, action, or proceeding of any kind or nature whatsoever against the Released Parties; (4) to assume all risks, express or implied, associated with all Claims released above, including, without limitation, all risks concerning entry into and participation in the Sweepstakes; and (5) that NEITHER SPONSOR NOR ANY OF THE RELEASED PARTIES HAVE MADE OR MAKE OR ARE RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, RELATIVE TO THIS SWEEPSTAKES OR A PRIZE, INCLUDING BUT NOT LIMITED TO, ITS QUALITY OR FITNESS OR MERCHANTABILITY, AND ALL PRIZES ARE TENDERED TO ENTRANTS ON AN "AS IS" BASIS.  THERE ARE NO WARRANTIES THAT EXTEND BEYOND THE DESCRIPTION ON THE FACE OF ANY PROMOTIONS OR MATERIALS OF ANY PRIZE.
   
   In case of dispute as to the identity of any entrant, entry will be declared made by the authorized account holder of the e-mail address associated with the Instagram account used to submit the entry. “Authorized Account Holder” is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Any potential winner may be requested to provide proof that such winner is the authorized account holder of the e-mail address associated with the winning entry or other proof of identity. The Released Parties are not responsible for technical, hardware, software, network or other communications malfunctions, errors or failures of any kind, lost, interrupted or unavailable network connections, Website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Sweepstakes. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Sweepstakes should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, winners will be selected from all eligible participants prior to and/or after (if appropriate) the action taken. Entrants who do not comply with these Official Rules or attempt to interfere with this Sweepstakes in any way shall be disqualified. Released Parties are not responsible for any typographical, display, input, or other error in any Sweepstakes materials, or for any errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of entries, or in the announcement of prizes, including such error that may give an erroneous indication that a prize has been won.
   
   
9. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (a) any incorrect or inaccurate information,  whether caused by printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes or provided by entrants; (b) technical failures or errors of any kind, including, but not limited, to malfunctions, interruptions, or disconnections to the internet, in phone lines, computers, servers, printers, or network hardware or software; (c) unauthorized human intervention in any part of the Sweepstakes, including, but not limited to, the entry process; (d) technical or human error which may occur in the administration of the Sweepstakes, including, but not limited to, the processing of entries; (e) late, lost, undeliverable, damaged or stolen mail or email; or (f) any injury, losses, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes, or the receipt, acceptance, use, inability to use, or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, if it is possible.  
   
   
10. GOVERNING LAW/ARBITRATION: The Sweepstakes and these Official Rules are governed by the laws of the State of Connecticut, without regard to its conflicts of law rules. As a condition of participating in this Sweepstakes, participants agree that any dispute or cause of action relating in any way to these Official Rules or the Sweepstakes shall be submitted to confidential arbitration in Stamford, Connecticut. Arbitration shall be conducted under the rules then prevailing of the American Arbitration Association.  The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction.  To the fullest extent permitted by applicable law, no arbitration by any party under these Official Rules shall be joined to an arbitration involving any other party subject to these Official Rules, whether through class arbitration proceedings or otherwise.  In no event shall the arbitrator be entitled to award exemplary, treble or any other form of punitive damages, regardless of the claims raised.
    
    
11. SEVERABILITY: If the application of any provision of these Official Rules to any particular facts or circumstances shall for any reason be held to be invalid, illegal or unenforceable by a court, arbitration panel or other tribunal of competent jurisdiction, then (a) the validity, legality and enforceability of such provision as applied to any other particular facts or circumstances, and the other provisions of these Official Rules, shall not in any way be affected or impaired thereby; and (b) such provision shall be enforced to the maximum extent possible. In addition, if any provision contained in these Official Rules shall for any reason be held to be excessively broad as to duration, geographical scope, activity, or subject, it shall be construed by limiting and reducing it, so as to be enforceable to the extent compatible with applicable law.
    
    
12. ENTRANTS PERSONAL INFORMATION: Information collected from entrants is subject to Sponsor’s Privacy Policy. 
    
13. WINNER’S LIST: The name of the Sweepstakes winner will be announced via the @mountainvalleywater Instagram account after the drawing on or around April 29, 2025 via an update to the original Facebook/Instagram post that announced the Sweepstakes on April 17, 2025. The announcement will be viewable at that location for no less than sixty (60) days following the end of the Sweepstakes period.
